Wills and Taxes
“In this world nothing is certain but death and taxes” – Benjamin Franklin. All taxes owing to the government is payable even after the death of the person. The taxes would generally be divided into two types, that is personal taxes, which include income taxes and property/asset taxes, which include real property gain tax. In this area, we will be sharing information on how to identify each of the taxes and plan on taxes respectively.
Wills and Debts
All debts owed by the testator of the Will is payable by the estate even after the death of the testator. The debt would not be transferred to the beneficiary of the Will, but the debt would need to be paid off before the estate can be distributed to the beneficiary of the Will. Despite thereof, the executor of the Will would be accountable to the creditor of the testator’s debt. In this area, we will be sharing information as to the planning of debt cancellation and what is the role and duties of the executor of a Will.
Testamentary Trust and Family Arrangements
We make our family arrangements, through a living trust or such other pre-arrangement before death, for our family members before we are to leave this world. We can do so by setting up a testamentary trust under a Will. Despite thereof, we shall not overlook the need to have proper and practical planning for either the family arrangement or setting testamentary trust, in particular, to consider the mode of funding for either your family arrangements or testamentary trust. In this area, we will be sharing information on the planning of family arrangements and/or testamentary trust, and to choose the mode of funding available.
Execution of a Will and distribution of Estates
Despite the testator having a good Will, the executor of the Will needs to understand the process of execution of the Will, from getting the court order to representing the estate of the testator until the distribution of the estate to the beneficiary. In this area, we will be sharing information on the process of execution of the Will and the cost and expense needed for the said process to the planning of family arrangements and/or testamentary trust, and to choose the mode of funding available.
